We have developed this Privacy Policy to provide transparency into our privacy practices and principles in a format that is easy to read and understand.

Privacy Policy

Effective Date: November 1, 2011.

This Privacy Policy describes our policies on the collection, use, and disclosure of your information in connection with your use of our websites, emails, and mobile applications ("Site"). The terms "we," "us," and "Broken Thumbs Apps" refer to W3 Innovations, LLC, a California limited liability company. When you use the Site, you consent to our collection, use, and disclosure of your information as described in this Privacy Policy.

I. INFORMATION WE COLLECT

We collect and store limited information from or about you. The information we do collect relates to your activity on the Site and is not, in itself, personally identifiable. In other words, the information we collect does not enable us to determine your identity. Rather, we collect and store information related to your use of the Site, such as IP address, unique device identifier (i.e., "UDID"), the pages you view, your game-play activity, and the date and time of your visit. We also collect transaction information you provide when you request information or purchase a product or service from us through the Site. Finally, we collect your email address if you contact us for customer support, but we do this solely for the purpose of responding directly on a one-time basis to a specific inquiry. All email addresses collected for this purpose are deleted within 10 business days after use.

We do not collect precise information about the location of your mobile device.

II. THIRD PARTIES

As described above, we do not collect personally identifiable information and, therefore, we do not rent, share, sell, or trade such information with third parties. However, we do work with third parties, and they may have access to some of the non-personally identifiable user information we collect.

a. Advertising: We allow third parties to provide advertising services within our applications, which helps us keep the cost of our applications low. Advertisers and advertising networks use some of the information collected by our applications, including the unique identification ID ("UDID") of your device. These third parties may also obtain anonymous information about other applications you have downloaded to your mobile device, the mobile websites you visit, your non-precise location information (e.g., your zip code), and other non-precise location information in order to help analyze and serve anonymous targeted advertising on our applications and elsewhere.

b. Service Providers: We outsource some of our technical and customer support, tracking and reporting functions, quality assurance testing, and other services to third parties. We may share information from or about you with them so they can perform their services.

c. Aggregate Information: We may share user information in the aggregate with third parties, such as advertisers and content distributors. For example, we may disclose the number of users that have seen, or clicked on, advertisements.

d. Business Transfers: We may share information from our about you with subsidiaries, joint ventures, or other companies under common control, in which case we will require them to honor this Privacy Policy. If another company acquires W3 Innovations, LLC or Broken Thumbs Apps or all or substantially all of our assets, that company will possess the same information, and we will request but cannot ensure that the buyer will assume the rights and obligations with respect to that information as described in this Privacy Policy.

e. Investigations: We may investigate and disclose information from or about you if we have a good faith belief that such investigation or disclosure is (i) reasonably necessary to comply with legal process and law enforcement instructions and orders, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process served on us; (ii) helpful to prevent, investigate, or identify possible wrongdoing in connection with the Site; or (iii) necessary to protect our rights, reputation, property, or that of our users, affiliates, or the public.

f. Links: The Site may contain links to unaffiliated third party websites and applications. We are not responsible for their privacy practices. We recommend you read the privacy policies on all such third party websites and applications.

III. OPTING OUT

You can stop all collection of information by an application easily by uninstalling the application. You may use the standard uninstall processes available as part of your mobile device or via the mobile application marketplace or network.

IV. CHILDREN

We recognize the need for additional privacy protections with respect to personal information belonging to children. Given these heightened concerns, we do not collect personally identifiable information (other than as provided above) from any of our users, regardless of their age.

V. SECURITY

We follow generally accepted industry standards to protect all user information submitted to us, both during transmission and once we receive it. No method of transmission over the internet or via mobile device, or method of electronic storage is 100% secure, however. Therefore, while we strive to use commercially reasonable means to protect your information, we cannot guarantee its absolute security.

VI. DATA RETENTION

We will retain data you submit to us only for as long as is reasonably necessary to fulfill the purpose for which the data was submitted (e.g., to respond to a customer service inquiry). Other information we collect (e.g., transaction data, UDID, game-play activity) will be retained for as long as you have the application installed on your handset and for a reasonable time thereafter.
